Terms of Service for Highland Forage Co.

1. Introduction and Acceptance of Terms
These Terms of Service (the “Terms”) govern your access to and use of the services, events, workshops, walks, demonstrations, and related offerings provided by Highland Forage Co. (the “Company”, “we”, “us”, or “our”).
By booking, attending, purchasing, or otherwise using any service offered by Highland Forage Co., you agree to be bound by these Terms. If you do not agree to these Terms, you must not book or use our services.
These Terms apply to all participants, customers, clients, and visitors who engage with our services, including guided wild food foraging walks, seasonal mushroom identification sessions, wild herb and edible plant workshops, private group foraging experiences, corporate team-building foraging events, and forage-to-table cooking demonstrations.
2. Scope of Services
Highland Forage Co. provides educational and experiential outdoor services focused on wild food foraging and related activities. Our services may include, without limitation:
- Guided wild food foraging walks;
- Seasonal mushroom identification sessions;
- Wild herb and edible plant workshops;
- Private group foraging experiences;
- Corporate team-building foraging events; and
- Forage-to-table cooking demonstrations.
Our services are intended for educational, recreational, and experiential purposes only. We do not guarantee the availability, abundance, safety, edibility, or suitability of any wild plant, fungus, or other natural material encountered during a session.
Any information provided during our services is general in nature and should not be treated as medical, nutritional, botanical, mycological, or legal advice. Participants are solely responsible for their own decisions regarding consumption or use of any foraged item.
3. User Obligations and Responsibilities
By participating in our services, you agree to:
- Provide accurate, complete, and up-to-date information when booking or communicating with us;
- Follow all instructions, safety guidance, and reasonable directions given by our staff, guides, or instructors;
- Act responsibly and exercise caution in outdoor environments, including uneven terrain, weather exposure, and wildlife;
- Disclose any relevant medical conditions, allergies, dietary restrictions, mobility limitations, or other circumstances that may affect your participation;
- Ensure that any minors in your care are adequately supervised at all times and are suitable to participate in the relevant activity;
- Refrain from collecting, consuming, or handling any wild food unless expressly instructed and permitted to do so by us;
- Respect private property, protected habitats, conservation rules, and applicable laws and regulations;
- Not bring pets, weapons, illegal substances, or hazardous items to any event unless we have expressly agreed otherwise;
- Use appropriate clothing and footwear for outdoor activities; and
- Conduct yourself in a respectful manner toward staff, other participants, landowners, and members of the public.
You acknowledge that foraging involves inherent risks, including but not limited to slips, trips, falls, insect bites, allergic reactions, adverse weather, and accidental ingestion of harmful species. You participate at your own risk, subject to the limitations set out in these Terms.
4. Payment Terms and Conditions
Unless otherwise stated at the time of booking, all fees must be paid in full at the time of reservation or by the deadline specified on the invoice or booking confirmation.
- Prices are stated in pounds sterling (GBP) unless otherwise indicated.
- We reserve the right to change prices at any time before a booking is confirmed.
- A booking is not confirmed until payment has been received in full, or we have otherwise confirmed the reservation in writing.
- For corporate, private, or custom events, a deposit may be required to secure the booking, with the balance due by the date specified in the invoice.
- Failure to pay on time may result in cancellation of the booking without liability to us.
Where applicable, any taxes, fees, or charges imposed by law will be added to the price or included as required. You are responsible for ensuring that your payment method is valid and that sufficient funds are available.
5. Cancellation and Refund Policy
Our cancellation and refund policy applies unless a different policy is expressly stated in writing for a specific event or booking.
- If you cancel more than 14 days before the scheduled service, you may be eligible for a full refund, less any non-recoverable processing fees.
- If you cancel between 7 and 14 days before the scheduled service, you may be eligible for a partial refund or credit at our discretion.
- If you cancel less than 7 days before the scheduled service, no refund is guaranteed.
- Failure to attend, late arrival, or inability to participate for any reason within your control will generally be treated as a cancellation with no refund.
We reserve the right to cancel, reschedule, or modify any service due to weather conditions, safety concerns, insufficient bookings, staff illness, land access issues, force majeure events, or any other reasonable cause. If we cancel a service, we will offer either a refund or an alternative date, at our discretion, unless the cancellation is due to circumstances beyond our reasonable control, in which case our liability is limited as set out in these Terms.
Refunds, where approved, will be processed using the original payment method where reasonably possible and within a reasonable time.
6. Liability Limitations
To the fullest extent permitted by applicable law, Highland Forage Co. excludes and limits liability for any loss, damage, injury, claim, or expense arising out of or in connection with your participation in our services, except where such liability cannot legally be excluded.
Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.
Subject to the foregoing, we shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive losses;
- Loss of profit, revenue, business, goodwill, or anticipated savings;
- Loss or corruption of data;
- Any illness, allergic reaction, poisoning, or adverse outcome resulting from your failure to follow instructions or from consuming any wild food without proper verification;
- Any injury or damage caused by your own actions, the actions of third parties, or conditions outside our reasonable control;
- Any loss arising from inaccurate information supplied by you;
- Any damage to personal property brought to an event, except to the extent caused by our negligence and required by law.
You acknowledge that wild food foraging carries inherent risks and that identification of species can be complex and subject to environmental variation. You are solely responsible for independently verifying any item before consumption or use.
7. Intellectual Property Rights
All content, materials, methods, handouts, photographs, videos, logos, branding, text, graphics, course materials, recipes, and other intellectual property provided by Highland Forage Co. remain our property or the property of our licensors, as applicable.
You are granted a limited, non-exclusive, non-transferable, revocable licence to use materials provided to you solely for your personal, non-commercial use in connection with the relevant service.
You must not, without our prior written consent:
- Copy, reproduce, distribute, publish, or adapt our materials for commercial purposes;
- Record, photograph, or film our services where prohibited by us;
- Use our name, logo, or branding in a misleading manner;
- Sell, sublicense, or exploit our materials or methods.
Any feedback, suggestions, or ideas you provide to us may be used by us without restriction or compensation, unless otherwise agreed in writing.
8. Data Protection and Privacy
We process personal data in connection with bookings, communications, safety management, customer service, and the delivery of our services. We will handle personal data in accordance with applicable data protection and privacy laws.

- War, terrorism, civil unrest, or government action;
- Transport disruption;

Where a force majeure event affects a booking, we may reschedule, modify, or cancel the service. We will use reasonable efforts to notify you as soon as practicable.
10. Changes to Terms
We may update or revise these Terms from time to time to reflect changes in our services, business practices, or legal requirements. The updated Terms will take effect from the date stated in the revised version, or upon publication if no date is stated.
It is your responsibility to review the Terms periodically. Your continued use of our services after any changes have been posted constitutes acceptance of the updated Terms.
11. Applicable Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them, their subject matter, or their formation shall be governed by and construed in accordance with the laws applicable in the jurisdiction in which Highland Forage Co. operates, subject to any mandatory consumer protection laws that apply to you.
Subject to applicable law, the courts having competent jurisdiction over the place of our principal business operations shall have exclusive jurisdiction to settle any dispute or claim arising from or related to these Terms.

13. Severability Clause
If any provision of these Terms is found to be unlawful, invalid, or unenforceable by a court or other competent authority, that provision shall be deemed severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
If any invalid or unenforceable provision would be valid or enforceable if part of it were deleted, that provision shall apply with the minimum modification necessary to make it valid and enforceable.
